In such case, the new version of the General Terms will be available on the Website along with its effective date. The applicable conditions will be those in force on the date the Client validates the booking.\nThe Client declares having read the General Terms, prior acceptance of which is mandatory before validating any booking. Any validated booking entails express and complete acceptance of the General Terms and waiver of any right to rely on the Client&#8217;s own purchasing conditions or any other conditions. When the booking is made on the Hotel&#8217;s Website, the Client declares having read the General Terms and having accepted them by ticking the box provided for this purpose before validating the booking.\nThe Client has the option to save and print these general terms and conditions using the standard features of their browser or computer.\n<h2>Scope<\/h2>\nThe General Terms apply to any booking made directly with the Provider or online via the booking services of the Hotel&#8217;s Website.\nThe General Terms apply to all services offered by the Hotel.\nThe registration of the booking and the sending of the confirmation shall constitute proof of the transaction and acceptance of the operations carried out.\n<h2>Capacity<\/h2>\nThe Client declares that they are acting for personal purposes which do not fall within the scope of their commercial, industrial, craft, liberal or agricultural activity, and that they have full legal capacity to enter into these General Terms.\nThe Client declares being responsible for the use of the Hotel&#8217;s Website booking service, both in their own name and on behalf of third parties, in particular minors. In this respect, the Client guarantees the truthfulness and accuracy of the information provided, both by themselves and by any minors in their care at the time of booking.\nAny fraudulent use of the Hotel&#8217;s booking services or use that contravenes the General Terms may result in refusal of access to the services offered and may give rise to legal proceedings before the competent courts.\n<h2>Formation of the contract<\/h2>\nThe contract is deemed to be formed as soon as a booking number has been assigned by the Provider to the Client and communicated upon confirmation of the booking, by any means of communication (telephone, email, post, etc.).\n<h2>Booking<\/h2>\nThe Client selects services from those offered by the Provider and presented on the Hotel&#8217;s Website according to their needs.\nThe Client acknowledges having read the nature, purpose and booking terms of the services available on the Hotel&#8217;s Website and having requested and obtained the necessary and\/or additional information to make their booking with full knowledge of the facts.\nThe Client is solely responsible for the choice of services and their suitability for their needs, such that the Provider cannot be held liable in this respect.\nThe booking is deemed accepted by the Client upon completion of the booking process.\n<h2>Booking procedures<\/h2>\nBookings for services offered by the Hotel may be made by telephone at the following number: <a href=\"tel:+33388321454\"><span style=\"color: #dc4e57;\">+33 (0)3 88 32 14 54<\/span><\/a>, by email or online via the Hotel&#8217;s Website <a href=\"mailto:info@clapclap-strasbourg.com\"><span style=\"color: #dc4e57;\">info@clapclap-strasbourg.com<\/span><\/a>\n<h2>Proof of transaction<\/h2>\nIt is expressly agreed that, save for obvious error proven by the Client, the data stored in the Provider&#8217;s information system, on computer or electronic media, shall constitute evidence of the bookings made by the Client. Accordingly, such data may be produced as evidence in any litigation or other proceedings, and shall be admissible, valid and enforceable between the parties in the same way, under the same conditions and with the same evidential value as any document that would be established, received or kept in writing.\n<h2>Prices<\/h2>\nThe prices relating to the booking are indicated before and at the time of booking.\nThe amount to be paid by the Client includes the price of the stay (unit price of the room selected by the Client multiplied by the number of nights) to which are added any options chosen at the time of booking (unit price multiplied by the quantity ordered), where applicable. Unless otherwise stated on the Website, options (breakfast) not offered at the time of booking are not included in the price.\nPrices are indicated inclusive of all taxes (VAT included), in euros, and are only valid for the date or period indicated on the Website.\nThe tourist tax, indicated for each rate, is payable directly on site at the Hotel unless otherwise specified at the time of booking.\nAny modification or introduction of new government or local taxes imposed by the competent authorities will be automatically passed on to the prices indicated on the date of invoicing.\nFor bookings made online on the Hotel&#8217;s Website, the Client has a choice between several rates:\na preferential rate for a non-modifiable and non-refundable booking;\na flexible rate for a modifiable and refundable booking, the modification and refund conditions of which are specified.\nThe Provider reserves the right to modify at any time and without notice the prices shown in brochures and other commercial materials, as well as the prices displayed in the establishments. Such modifications shall not apply to bookings previously accepted by the Provider.\n<h2>Payment terms<\/h2>\nAt the time of booking, the Client must provide the authentication details of their bank card in order to validate the booking. Failing this, the booking will be automatically cancelled.\nThe Hotel may also request the Client to present identification for the purposes of preventing bank card fraud.\nfor the preferential rate with prepayment: the total price of the booking is debited at the time of booking, from the bank card provided by the Client. The Client expressly acknowledges that this is a prepayment and that their card will be debited before their stay. The booking validated by the Client will only be considered effective after agreement from the relevant bank payment centres. In case of refusal by said centres, the booking will be automatically cancelled. Payment must be made with one of the bank cards indicated on the Website, through a secure web page. The details of the Client&#8217;s bank card will be encrypted with SSL (Secured Socket Layer) protocol up to 128 bits. The Client&#8217;s bank card details never transit on the Internet unencrypted.\nfor the flexible rate: no prepayment is required at the time of booking. The Client&#8217;s bank card number is required to validate the booking but the Client&#8217;s bank card will not be debited. Payment of the booking must be made to the Provider, directly at the Hotel upon the Client&#8217;s departure.\nfor non-prepaid rates online: The Hotel may ask the Client, upon arrival, for a security deposit or an authorisation to debit the credit card in order to guarantee payment of the amounts corresponding to the services consumed on site.\npayment of extras: any extras (bar, telephone, etc.) which are not explicitly included in the rates shall be payable directly on site at the end of the stay. Failing this, the Client expressly authorises the Provider to debit the bank card left as guarantee for the payment of extras.\n<h2>Modification of the booking<\/h2>\nThis provision does not apply to bookings made at the preferential rate.\nModification at the Client&#8217;s request: booking modifications may be made free of charge, subject to availability. Any price supplement resulting from modifications requested by the Client will give rise to additional invoicing.\nModification at the Provider&#8217;s request: in the event of unavailability of the rooms booked due to unforeseen circumstances, the Provider undertakes to relocate the Client, at no additional cost, to a hotel of at least equivalent standard. The transfer costs related to this relocation will be borne by the Provider.\n<h2>Booking cancellation terms<\/h2>\nThe Client is reminded that, in accordance with Article L. 121-20-4 of the French Consumer Code, they do not have the right of withdrawal provided for in Article L. 121-20 of the French Consumer Code.\nBookings made at the preferential rate cannot be cancelled by the Client.\nFor other bookings, any cancellation must be sent by email with the booking number.\nFor bookings made on the Hotel&#8217;s Website, the Client may cancel their booking by clicking on the link at the end of their confirmation email and following the instructions displayed on their screen.\nIf the booking includes booking fees, these will not be refundable. The amount of fees charged to the Client in the event of cancellation of their booking is indicated at the time of their booking.\nIn case of cancellation, if the Client has paid all or part of the booking online, this amount will be refunded after deduction of cancellation fees.\nIt is advisable to cancel as soon as possible once the cause of cancellation has arisen.\nFor the calculation of cancellation deadlines, it is agreed that the &#8222;Expected arrival date&#8220; shall be the day of the first night scheduled at noon (12:00), local time.\nCancellation by the Client for a one-night stay: this cancellation must occur no later than one (1) day before the expected arrival date. For any cancellation occurring less than one (1) day before the expected arrival date or in the event of no-show at the Hotel, the total amount of the booking will be charged, excluding extras.\nCancellation by the Client for a stay of more than one night: this cancellation must occur no later than one (1) day before the expected arrival date. For any cancellation occurring less than one (1) day before the expected arrival date or in the event of no-show at the Hotel, the first night will be charged, excluding extras.\nCancellation by the Provider: in the event of cancellation by the Provider, no fees will be charged to the Client.\n<h2>Stay at the hotel<\/h2>\nReception is open 24 hours a day.\nUnless expressly stated otherwise, the Client may arrive at the Hotel from 2:00 PM on the first day of their booking and must vacate the room before 11:00 AM on the last day of their booking. Failing this, an additional night will be charged.\nThe Client accepts and undertakes to use the room as well as the common areas made available to them with due care. Any behaviour contrary to safety and\/or hygiene principles, good morals and\/or public order may lead the Provider to ask the Client to leave the Hotel without any compensation and\/or refund if payment has already been made.\nAny damage caused by the Client in the booked room may be directly charged to them. Penalties up to a maximum equal to the price of the booked room may be applied if the Client does not respect the signage prescribing the prohibition of smoking in their room, where such signage is posted.\nThe Client also undertakes that the IT resources made available to them by the Hotel (in particular the WiFi network) shall in no way be used for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorisation of the rights holders provided for in Books I and II of the French Intellectual Property Code where such authorisation is required.\n<h2>Client&#8217;s commitments and liability<\/h2>\nThe Client is solely responsible for the information provided at the time of creating their account and\/or any booking. The Provider cannot be held liable in the event of erroneous or fraudulent information provided by the Client. Furthermore, the Client is solely responsible for the use of their account and any booking made, both in their own name and on behalf of third parties, including minors, unless they can demonstrate fraudulent use resulting from no fault or negligence on their part. In this respect, the Provider must be immediately notified of any misuse or fraudulent use of their email address.\nThe Client undertakes to use the Hotel&#8217;s Website and the services offered thereon in compliance with applicable regulations and these General Terms. In the event of any breach by the Client of their obligations under these General Terms, the Client shall be liable for any damage caused by them to the Hotel, the Provider or third parties. In this respect, the Client undertakes to indemnify the Provider against any claims, actions or recourse of any nature that may result therefrom and to indemnify them for any damages, costs or compensation whatsoever relating thereto.\nThe Client, in particular, undertakes, by making a definitive booking, to pay the price and to comply with the specific conditions relating thereto, where applicable.\nAny booking or payment which is irregular, ineffective, incomplete or fraudulent for a reason attributable to the Client shall result in the cancellation of the order at the Client&#8217;s expense, without prejudice to any civil or criminal action against the latter.\n<h2>Provider&#8217;s liability<\/h2>\nIn the online booking process, the Provider has an obligation of means. Its liability cannot be engaged for damages resulting from the use of the Internet network such as in particular loss of data, intrusion, viruses, service interruption, etc. Hyperlinks may redirect to sites other than the Hotel&#8217;s Website, which disclaims all liability regarding the content of these sites and the services offered. The decision to consult third-party websites is therefore the sole responsibility of the Client.\nThe photographs presented on the Hotel&#8217;s Website are not contractual. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the Hotel give as accurate an overview as possible of the services offered, variations may occur, in particular due to changes in furniture or possible renovations. The Client shall not be entitled to any claim on this account.\nIn accordance with the laws and regulations governing intellectual property rights, the use and\/or reproduction of all or part of the elements comprising the offers on the Hotel&#8217;s Website is strictly prohibited.\nThe Provider shall not incur any liability for any indirect damages resulting from these terms, in particular those caused by a third party, the Client or the Hotel&#8217;s partners.\n<strong>Personal data<\/strong>\nThe Client acknowledges and accepts that the Hotel, as data controller, collects and processes personal data necessary for the purposes of managing bookings and clients, for the needs of invoicing and payments and to carry out its commercial actions and satisfaction surveys. The data is intended for the Hotel and its service providers.\nThe Client is informed, on each of the personal data collection forms, of the mandatory or optional nature of the answers and information by the presence of an asterisk.\nThe processing of information communicated through the Hotel&#8217;s Website meets the legal requirements regarding the protection of personal data, the information system used ensuring optimal protection of this data.\nThe Client has, in accordance with the national and European regulations in force, a right of access, rectification and deletion of personal data concerning them and may object to the processing of their data. A cookie is a computer file, stored on the hard drive of the Client&#8217;s computer. Its purpose is to signal a previous visit by the Client to the Hotel&#8217;s Website. Cookies are only used by the Provider for the purpose of personalising the service offered to the Client.\nThe Client retains the possibility of refusing cookies by configuring their Internet browser. They then lose the possibility of personalising the service delivered to them by the Provider via the Website.\n<h2>Intellectual property<\/h2>\nRegarding the use of the Hotel&#8217;s Website, the Provider is the holder of all intellectual property rights relating to the Website.\nThe elements accessible on the Website, in particular in the form of texts, photographs, images, icons, video sounds, software, databases, are also protected by intellectual and industrial property rights and other proprietary rights held by the Provider.\nExcept with the express, written and prior agreement of the Provider, it is expressly forbidden to reproduce, exploit, distribute or use in any capacity whatsoever, even partially, any elements present on the Website, or to distribute a simple or hypertext link.\n<h2>Entire agreement<\/h2>\nThese General Terms, the terms of sale of the rate booked by the Client and the booking confirmation express the entirety of the parties&#8216; obligations and constitute confirmation of the contract including all the information provided for in Article L. 221-5 of the French Consumer Code within the meaning of Article L. 221-13 of the French Consumer Code.\nThe documents forming the contractual commitments between the parties are, in decreasing order of priority, the booking confirmation, including the specific conditions of the booked rate, validated by the Client, and these General Terms.\nIn the event of a contradiction between the booking confirmation and the General Terms, the provisions appearing on the booking confirmation validated by the Client shall be the only ones applicable for the obligation in question.\n<h2>Force majeure<\/h2>\nThe Provider, the Hotel and the Client cannot be held liable in the event of non-performance of their obligations resulting from a force majeure event, as defined in Article 1218 of the French Civil Code.\nIt is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations.\nEach party bears the burden of all costs incumbent upon it and resulting from the force majeure event.\n<h2>Claims<\/h2>\nAny claim relating to a booking must be sent by the Client by registered letter with acknowledgement of receipt to the following address of the Hotel, no later than within fifteen (15) days following the last night, under penalty of forfeiture:\nCLAPCLAP (SAS) \u2013 24 rue du Faubourg National \u2013 67000 STRASBOURG, France.\n<h2>Jurisdiction &amp;
